1. Agreement to Terms
By accessing or using the services provided by TRULNK LLC ("TRULNK," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use our Service.
These Terms constitute a legally binding agreement between you and TRULNK LLC, a Georgia limited liability company.
2. Description of Service
TRULNK provides an AI-powered voice agent platform that answers phone calls on behalf of your business. Our Service includes:
- 24/7 AI voice agent to handle incoming calls
- Voicemail collection when the AI agent is temporarily unavailable
- Call recording and transcription services
- Calendar integration for appointment scheduling (Google Calendar, Microsoft Outlook)
- Web-based dashboard for managing your agent and reviewing calls
- Call analytics including sentiment analysis and AI-generated summaries
- Knowledge base management for customizing agent responses
- Unlimited inbound calls
3. Eligibility and Account Registration
To use the Service, you must:
- Be at least 18 years of age
- Represent a legitimate business entity or be a sole proprietor
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Free Trial and Subscription
4.1 Free Trial
New customers are eligible for a 7-day free trial with full access to all features. A valid credit card is required to start the trial. If you do not cancel before the trial period ends, your subscription will automatically begin and your card will be charged. Only one free trial is permitted per business entity. TRULNK reserves the right to charge the full subscription fee if it determines a trial is being abused or if a business has previously used a trial.
4.2 Subscription Pricing
After the trial period, the Service is billed at $199 per month per AI agent, with an option to pay annually. This includes unlimited inbound calls, call recording, transcription, calendar integration, and all platform features.
Optional add-ons are available, including additional phone numbers and additional concurrent call capacity, each billed separately at the rates listed on our pricing page.
4.3 Billing
Subscription fees are charged automatically on a monthly basis to the payment method on file. You authorize us to charge your payment method for all fees incurred. If payment fails, we may suspend or terminate your access to the Service.
4.4 Cancellation and Refunds
You may cancel your subscription at any time through your account dashboard or by contacting us at billing@trulnk.com. Cancellation takes effect at the end of your current billing period and you will retain access to the Service until then. No refunds will be provided for partial billing periods. If you cancel during your free trial, you will not be charged.
4.5 Price Changes
We reserve the right to modify pricing with 30 days advance notice. Price changes will not affect your current billing period.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable federal, state, local, or international law or regulation
- Make unsolicited calls, robocalls, or spam (must comply with TCPA, TSR, and all telemarketing regulations)
- Use the Service for telemarketing, debt collection, or political campaign calls without proper compliance
- Impersonate any person, business, or entity, or falsely state or misrepresent your affiliation
- Engage in any fraudulent, deceptive, or misleading activity
- Harass, abuse, threaten, or intimidate any person
- Transmit any malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service, servers, or networks
- Use the Service for any illegal purpose, including but not limited to fraud, money laundering, or terrorist financing
- Collect or harvest personal information without proper consent
- Use the Service in any manner that could damage, disable, or impair it
- Use the Service to handle protected health information (PHI) as defined by HIPAA, payment card data subject to PCI-DSS, student education records protected by FERPA, or other specially regulated data categories without ensuring your own independent compliance with applicable regulations
- Resell, sublicense, or redistribute the Service without our written consent
Violation of these policies may result in immediate termination of your account without refund.
6. Call Recording and Consent
The Service includes call recording functionality. You are solely responsible for complying with all applicable call recording laws. This includes:
- Federal wiretapping laws (18 U.S.C. § 2511)
- State call recording laws (including two-party consent states such as California, Florida, Illinois, and others)
- Industry-specific regulations
- International laws if you receive calls from outside the United States
The Service provides configurable options to announce call recording and AI disclosure at the start of each call. It is your responsibility to configure these settings appropriately for your jurisdiction and use case.
TRULNK is not liable for your failure to obtain proper consent or comply with applicable recording laws.
7. AI Disclosure
Our Service uses artificial intelligence to conduct phone conversations. Some jurisdictions require disclosure that callers are speaking with an AI or automated system. The Service provides configurable options to include AI disclosure in your agent's greeting.
You are responsible for determining whether AI disclosure is required in your jurisdiction and configuring your agent settings accordingly.
8. Data Ownership and License
8.1 Your Data
You retain all ownership rights to your business data, including call recordings, transcripts, knowledge base content, and any information you upload to the Service ("Your Data"). You grant TRULNK a limited, non-exclusive license to use Your Data solely to provide the Service. We do not use your call recordings or transcripts to train or improve AI models.
8.2 Caller Data
You are the data controller for information collected from your callers. You are responsible for providing appropriate privacy notices to your callers and handling any data requests from them.
8.3 Our Service
TRULNK retains all rights to the Service, including software, algorithms, AI models, user interface designs, and intellectual property. Nothing in these Terms grants you any right to our intellectual property except the limited right to use the Service as described herein.
8.4 Aggregated Data
We may use anonymized, aggregated usage metrics (such as call volume and feature usage) to improve the Service. This does not include the content of your calls, recordings, or transcripts, and such data will not identify you or your callers.
9. AI Service Limitations
Our AI voice agents are designed to assist with customer service but have limitations. You acknowledge and agree that:
- AI responses are automated and not reviewed by humans in real-time
- The AI may occasionally provide inaccurate, incomplete, or inappropriate responses
- You are responsible for monitoring AI interactions and correcting any issues
- The Service is not designed or intended for use in medical, legal, financial advisory, or emergency services contexts. You agree not to configure your AI agent to provide medical diagnoses, legal counsel, financial advice, or handle emergency calls (including 911-equivalent situations)
- TRULNK expressly disclaims all liability for any damages resulting from AI errors, inaccuracies, or use of the Service in prohibited contexts
You should regularly review call transcripts and adjust your agent's configuration and knowledge base to improve response quality.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency maintenance or security updates
- Third-party service provider outages (telecommunications, cloud hosting, etc.)
- Force majeure events beyond our reasonable control
In the event the AI agent is unavailable, the Service may route calls to a voicemail system. We do not guarantee that all calls will be answered by the AI agent.
TRULNK is not liable for any damages resulting from service interruptions or outages.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRULNK LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Lost profits or revenue
- Lost data or business interruption
- Loss of goodwill or reputation
- Damages arising from AI errors or inaccuracies
- Damages arising from service interruptions
- Any other consequential damages
THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF TRULNK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRULNK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless TRULNK LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your violation of any third-party rights
- Content you provide or upload to the Service
- Your failure to obtain proper consent for call recording
- Claims by your callers
13. Termination
13.1 Termination by You
You may cancel your subscription and terminate your account at any time through your account dashboard or by contacting us at billing@trulnk.com.
13.2 Termination by TRULNK
We may suspend or terminate your account immediately, without prior notice, for:
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent, illegal, or harmful activity
- Non-payment of fees
- At our sole discretion for any business reason
13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. You will have 30 days to download your data (call recordings, transcripts, etc.) after which it may be permanently deleted. We are not obligated to retain your data after this period.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRULNK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF AI RESPONSES
- UNINTERRUPTED OR ERROR-FREE SERVICE
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
16.1 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted in Cherokee County, Georgia, by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
16.2 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST TRULNK.
16.3 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Claims in small claims court are also excluded from the arbitration requirement, provided they remain in small claims court.
17. Telephone Regulations
You represent and warrant that you will use the Service only to handle inbound calls to phone numbers you have lawfully obtained through TRULNK. You will not use the Service for outbound calling, autodialing, or any activity that would violate the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), or any applicable state telemarketing laws. Violation of this section will result in immediate account termination.
18. Healthcare and HIPAA Disclaimer
TRULNK is not currently HIPAA-compliant. The Service has not been certified or audited for compliance with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") or its implementing regulations. If you are a covered entity or business associate as defined by HIPAA, you should not use the Service to create, receive, maintain, or transmit Protected Health Information ("PHI") as defined by 45 CFR §160.103 without first confirming that TRULNK has achieved HIPAA compliance and entering into a Business Associate Agreement ("BAA") with TRULNK.
TRULNK does not currently offer Business Associate Agreements. We are actively working toward HIPAA compliance and will update this section when BAAs become available. Using the Service to handle PHI without a BAA in place is a violation of these Terms and may expose you to regulatory liability.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TRULNK regarding the Service.
19.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
19.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
